Terms of Use
This is a translation. If the two versions differ, the Italian text prevails.
1. What this is about
These Terms govern the use of the Sweet Pal app, provided by F-T srl, Via Bianca di Savoia 17, 20122 Milan, Italy (info@ef-ti.com).
By creating an account and using the app you accept these Terms and acknowledge the Privacy Notice. Acceptance happens in the app, before sign-up, and is recorded together with the version of the documents in force at that moment. If you do not accept them, you cannot use the app.
They apply together with Apple's standard Licensed Application End User License Agreement (Apple EULA); if the two conflict, these Terms prevail as regards our relationship with you, to the extent Apple allows.
2. What Sweet Pal is
Sweet Pal supports a person living with type 1 diabetes in everyday life. In practice it:
- keeps the diary of glucose, meals, insulin and movement, collecting data from Apple Health and from what you record;
- shows and explains: charts, statistics, daily and weekly summaries, how your glucose went after a meal or an activity, recurring patterns, departures from the usual;
- projects the glucose trend of the next hours, and corrects the projection when new data arrives;
- simulates, for illustration, the expected effect of a meal, an activity or a bolus;
- converses: a chat based on artificial intelligence models, which remembers what you told it.
3. What Sweet Pal is not
It is not a medical device. Sweet Pal is a tool for keeping a diary, reading your own data and learning. It is not intended to diagnose, prevent, clinically monitor, treat or cure any disease, and it is not marked as a medical device under Regulation (EU) 2017/745.
It does not suggest insulin doses. The doses you see in the app are the ones you record, including the usual ones you tell us. Simulations show the effect of a dose you choose, to understand how things work: they are not advice. It does not diagnose, prescribe therapy or change your treatment plan. Nothing the app shows is medical advice.
It does not administer insulin and does not control devices. It is not connected to pumps, connected pens or automated systems: you decide and give the dose, with your diabetes team.
It is not reliable by definition. Forecasts and simulations are statistical calculations on your past data: they can be wrong, especially when data is scarce, old or incomplete, or when the day does not resemble previous ones. Glucose values the app receives from Apple Health may also arrive with a delay compared to when they were measured.
It is not an emergency service. In case of severe hypoglycaemia, ketoacidosis or any emergency, call emergency services (112 in the EU). Do not delay a clinical decision to wait for what the app says.
4. Who can use it
You must be at least 18 years old and able to enter into a contract.
Sweet Pal is designed for people with type 1 diabetes. It is not designed for other conditions, and using it for other purposes is at your own risk.
5. Your account
You need an account to use the app: you create it with Apple, with Google or with an email verified by a code. You are responsible for access to your device and your account. If you suspect unauthorised access, write to us.
You can delete the account from the app at any time: the linked data goes with it. Deleting the account does not cancel your subscription, which is managed by Apple (§8).
6. Your data stays yours
What you record and what you write remains yours. We process it to make the app work for you, in the ways and on the legal bases described in the Privacy Notice. We do not sell it, do not pass it on to advertisers, do not use it for advertising.
To provide the service we need a limited technical licence: to store, process and display your content inside the app, and to transmit it to the providers listed in the Privacy Notice when they are needed to answer. Nothing else.
If you give separate consent to data study, we also use it to improve the product, in aggregate form. It is off by default and you can turn it off whenever you want.
7. How to use it
Use the app for what it is made for. In particular, do not:
- enter other people's data without their knowledge and consent;
- use the app as your only reference to decide a therapy;
- try to circumvent technical or usage limits, extract the models, overload the services or access data that is not yours;
- reproduce or resell the app or parts of it.
We may suspend an account that puts the service or other users at risk, with notice when it is possible to give it.
8. Plans, free trial and payments
Plans. Sweet Pal is used with a subscription to one of two plans: Expert and Pro. Pro includes everything in Expert and adds features; the up-to-date list of what each plan includes is in the app, on the subscription screen. Each plan may have a daily conversation usage limit, shown in the app.
Purchase through Apple. Subscriptions are bought only from the App Store, with your Apple account, and are also governed by Apple's terms. The price is the one shown in the app and by the App Store before purchase, in your country's currency, taxes included.
Free trial. First-time subscribers to Pro may get one free month, once per Apple account. The duration and the price you will pay afterwards are shown before you confirm. If you do not cancel at least 24 hours before the trial ends, the subscription starts and you are charged.
Automatic renewal. The subscription, monthly or yearly, renews automatically at the end of each period for the same duration and price, unless you cancel at least 24 hours before. Your Apple account is charged within the 24 hours before renewal.
Changing plan or cancelling. You do it from Settings › your name › Subscriptions on the iPhone, or from the subscription screen in the app. Moving to Pro takes effect immediately; moving to Expert takes effect from the next renewal. Cancelling stops renewal: the plan stays active until the end of the period already paid.
Refunds. Payments are collected by Apple, and refunds are decided by Apple under its rules: you request them at reportaproblem.apple.com.
Credits. With the Expert plan some Pro features can be used once by paying with credits, bought in packs from the App Store. The app tells you how many credits each feature costs before you use it, and nothing is deducted without your confirmation. If a paid feature does not start, the credits are returned automatically. Credits do not expire, are not money, cannot be converted into money and cannot be transferred to other accounts; they can be used only with an active subscription, and they stay put if the subscription stops. A credit pack does not renew.
Without a subscription. Without an active subscription the app does not give access to its features, except for a short initial period after sign-up to get to know it. Your data stays where it is and you find it again when you subscribe again, until you delete the account.
Promotional codes. We may offer free or discounted periods through App Store offer codes, which you redeem from the app or from the App Store.
9. Artificial intelligence
Part of the features rely on artificial intelligence models from our providers. These models can make mistakes: they can misunderstand what you write, remember wrongly, or produce a confident but incorrect text. What the app says is not checked by a doctor.
The service may change model or provider, and answers may change accordingly. The models used may differ between Expert and Pro.
10. Service availability
We do our best to keep the app working, but we do not guarantee absolute continuity: maintenance, provider failures, system updates or network outages can make it temporarily unusable. Sweet Pal is constantly evolving: features can change, be suspended or removed; if a change removes a feature included in your plan, we tell you before renewal.
11. Limitation of liability
To the extent permitted by law, and without excluding liability for wilful misconduct, gross negligence, death or personal injury attributable to us, nor the rights that the law grants to consumers:
- we are not liable for the therapeutic decisions you make, even when they were influenced by a forecast or a simulation in the app;
- we are not liable for damage arising from wrong, missing or delayed data coming from sensors, Apple Health or other sources;
- we are not liable for temporary unavailability of the service.
12. Intellectual property
The app, its code, graphics, texts and the diabetes knowledge base belong to F-T srl or their respective owners. We grant you a personal, non-exclusive, non-transferable right to use the app under these Terms. Your data is not included: it remains yours (§6).
13. Termination
You can stop whenever you want: cancel the subscription with Apple and delete the account. We may stop providing the service, in whole or in part, with reasonable notice. Clauses that by their nature survive — intellectual property, liability, applicable law — remain in force.
14. Applicable law
Italian law applies, without prejudice to the mandatory protections that the law of your country of residence grants to consumers. For disputes with a consumer, the courts of the consumer's place of residence have jurisdiction.
15. Changes
When these Terms change substantially, the app asks you to accept them again, and the acceptance is recorded with the version of the text. If you do not accept the new version, you can stop using the app, cancel the subscription and delete the account.
